\u00abAssociazione\u00bb.<\/p>\n        <\/section>\n\n        <section id=\"art-2\">\n          <h2><span>2.<\/span> Finalit\u00e0 delle donazioni<\/h2>\n          <p>L'Associazione raccoglie donazioni volontarie per sostenere iniziative solidaristiche, umanitarie e di utilit\u00e0 sociale a favore di famiglie in condizioni di indigenza economica, minori e persone in stato di vulnerabilit\u00e0, in particolare in India.<\/p>\n          <p>In conformit\u00e0 con lo Statuto sociale e ai sensi dell'art. 5 del D.Lgs. 117\/2017, i fondi raccolti sono destinati al perseguimento di finalit\u00e0 civiche, solidaristiche e di utilit\u00e0 sociale, quali a titolo esemplificativo:<\/p>\n          <ul>\n            <li>distribuzione di generi alimentari, medicinali e beni di prima necessit\u00e0;<\/li>\n            <li>sostegno all'istruzione, scolarizzazione e tutela dell'infanzia vulnerabile;<\/li>\n            <li>interventi di assistenza sanitaria, socio-sanitaria e riabilitativa;<\/li>\n            <li>sussidi economici e materiali per nuclei familiari in condizioni di grave marginalit\u00e0;<\/li>\n            <li>ulteriori progetti umanitari coerenti con le finalit\u00e0 istituzionali dell'Associazione.<\/li>\n          <\/ul>\n          <p>Le attivit\u00e0 concretamente finanziate dipendono dai progetti attivi, dalle priorit\u00e0 individuate sul campo e dalle risorse economiche effettivamente disponibili.<\/p>\n        <\/section>\n\n        <section id=\"art-3\">\n          <h2><span>3.<\/span> Natura giuridica della donazione<\/h2>\n          <p>Le somme versate costituiscono erogazioni liberali (donazioni) volontarie, prive di controprestazione o corrispettivo in beni o servizi commerciali. La donazione non costituisce in alcun caso il pagamento o l'acquisto di un bene o servizio.<\/p>\n          <p>Ai sensi e per gli effetti dell'art. 783 del Codice Civile, il donatore, completando la transazione, attesta che l'importo erogato \u00e8 di <strong>modico valore<\/strong> in rapporto alle proprie condizioni economico-patrimoniali, perfezionando la donazione con la semplice corresponsione telematica, e dichiara di avere piena facolt\u00e0 e titolo per disporre della somma versata.<\/p>\n        <\/section>\n\n        <section id=\"art-4\">\n          <h2><span>4.<\/span> Modalit\u00e0 di pagamento e istruzioni per i bonifici<\/h2>\n          <p>Le donazioni possono essere effettuate tramite gli strumenti digitali e bancari messi a disposizione sul sito:<\/p>\n          <ul>\n            <li><strong>PayPal \/ Carte di pagamento:<\/strong> secondo i termini e gli standard di sicurezza del circuito emittente e della piattaforma di pagamento integrata;<\/li>\n            <li><strong>Bonifico bancario:<\/strong> da disporre utilizzando esclusivamente le coordinate bancarie ufficiali dell'Associazione.<\/li>\n          <\/ul>\n\n          <h3>Istruzioni vincolanti per i bonifici bancari<\/h3>\n          <p>Ai fini del buon esito del pagamento, della verifica preventiva di concordanza del beneficiario (<em>Verification of Payee<\/em>) e della corretta imputazione contabile e fiscale, il donatore \u00e8 tenuto a compilare l'ordine di bonifico inserendo con la massima precisione:<\/p>\n\n          <div class=\"gtc-bank\">\n            <div class=\"gtc-bank-row\">\n              <div class=\"gtc-bank-label\">Intestatario \/ Beneficiario<\/div>\n              <div class=\"gtc-bank-value\"><span>ORGANIZZAZIONE DI VOLONTARIATO GURU NANAK NAAM LEVA SANGAT<\/span>\n                <button type=\"button\" class=\"gtc-copy\" data-copy=\"ORGANIZZAZIONE DI VOLONTARIATO GURU NANAK NAAM LEVA SANGAT\">Copia<\/button><\/div>\n            <\/div>\n            <div class=\"gtc-bank-row\">\n              <div class=\"gtc-bank-label\">IBAN<\/div>\n              <div class=\"gtc-bank-value\"><span class=\"gtc-mono\">IT42 D030 6909 6061 0000 0191 958<\/span>\n                <button type=\"button\" class=\"gtc-copy\" data-copy=\"IT42D0306909606100000191958\">Copia<\/button><\/div>\n            <\/div>\n            <div class=\"gtc-bank-row\">\n              <div class=\"gtc-bank-label\">Banca di appoggio<\/div>\n              <div class=\"gtc-bank-value\"><span>INTESA SANPAOLO<\/span><\/div>\n            <\/div>\n            <div class=\"gtc-bank-row\">\n              <div class=\"gtc-bank-label\">Causale<\/div>\n              <div class=\"gtc-bank-value\"><span>Erogazione liberale - DONAZIONE - CF: <em style=\"font-weight:400\">(aggiungi il tuo Codice Fiscale)<\/em><\/span>\n                <button type=\"button\" class=\"gtc-copy\" data-copy=\"Erogazione liberale - DONAZIONE - CF: \">Copia<\/button><\/div>\n            <\/div>\n          <\/div>\n          <p class=\"gtc-note\">Inserire esattamente l'intestazione sopra riportata per superare la verifica bancaria del beneficiario.<\/p>\n\n          <p>La donazione si considera perfezionata e ricevuta al momento dell'effettivo accredito dei fondi sul conto corrente bancario dell'Associazione o all'atto della conferma irrevocabile della transazione da parte del prestatore di servizi di pagamento (PSP).<\/p>\n          <p>Il donatore \u00e8 responsabile dell'esattezza dei dati inseriti. Eventuali commissioni bancarie o costi di conversione valutaria applicati dall'intermediario prescelto dal donatore restano a carico di quest'ultimo o possono essere detratti dall'importo netto incassato dall'Associazione in conformit\u00e0 alle condizioni applicate dal provider.<\/p>\n        <\/section>\n\n        <section id=\"art-5\">\n          <h2><span>5.<\/span> Utilizzo, gestione dei fondi e trasferimenti internazionali<\/h2>\n          <p>Le risorse economiche ricevute sono gestite dall'Associazione con diligenza, trasparenza e vincolo di destinazione alle sole attivit\u00e0 istituzionali statutarie, nel rispetto delle norme contabili e del divieto di distribuzione, anche indiretta, di utili o avanzi di gestione (art. 8 D.Lgs. 117\/2017).<\/p>\n          <p>I fondi possono essere trasferiti in India per l'attuazione diretta delle iniziative o per il tramite di enti partner, fornitori o organizzazioni non governative locali. A tal fine, l'Associazione opera nel pieno rispetto:<\/p>\n          <ol>\n            <li>della normativa antiriciclaggio e di contrasto al finanziamento del terrorismo (D.Lgs. 231\/2007 e successive modifiche);<\/li>\n            <li>delle normative locali applicabili ai trasferimenti internazionali verso l'India, inclusa la conformit\u00e0 al <em>Foreign Contribution Regulation Act<\/em> (FCRA) e l'utilizzo dei canali bancari autorizzati.<\/li>\n          <\/ol>\n        <\/section>\n\n        <section id=\"art-6\">\n          <h2><span>6.<\/span> Donazioni per progetti specifici<\/h2>\n          <p>Qualora il sito permetta di destinare la donazione a una campagna o a uno specifico progetto, l'Associazione si impegna a vincolare la somma al progetto prescelto, compatibilmente con la fattibilit\u00e0 operativa e il raggiungimento del budget di raccolta.<\/p>\n          <p>Ove il progetto indicato risulti gi\u00e0 integralmente finanziato, sospeso, terminato o oggettivamente impossibile da realizzare, l'Associazione provveder\u00e0, ove possibile, a informare il donatore per concordare la riallocazione su un'iniziativa analoga. In difetto, i fondi saranno destinati ad altri progetti umanitari coerenti con lo scopo originario e con gli scopi statutari dell'ente.<\/p>\n        <\/section>\n\n        <section id=\"art-7\">\n          <h2><span>7.<\/span> Spese operative e di gestione<\/h2>\n          <p>Al fine di garantire l'adeguato coordinamento, il monitoraggio sul campo, la tenuta della contabilit\u00e0 e la gestione tecnica delle piattaforme di raccolta, una quota ragionevole e documentabile delle risorse raccolte pu\u00f2 essere imputata a spese amministrative e di supporto generale, sempre nel rispetto dei parametri di congruit\u00e0 ed efficienza previsti per gli Enti del Terzo Settore.<\/p>\n        <\/section>\n\n        <section id=\"art-8\">\n          <h2><span>8.<\/span> Rendicontazione e trasparenza<\/h2>\n          <p>L'Associazione tiene regolarmente le scritture contabili e redige il bilancio di esercizio e la rendicontazione delle raccolte fondi secondo le linee guida ministeriali vigenti (D.M. 9 giugno 2022 e art. 87 D.Lgs. 117\/2017).<\/p>\n          <p>I rendiconti, le relazioni di missione e gli aggiornamenti sulle iniziative realizzate sono messi a disposizione sul sito istituzionale in adempimento degli obblighi di pubblicit\u00e0 e trasparenza. La diffusione di immagini o dati relativi ai beneficiari avviene sempre a tutela della dignit\u00e0, dell'onore e della riservatezza delle persone assistite.<\/p>\n        <\/section>\n\n        <section id=\"art-9\">\n          <h2><span>9.<\/span> Rimborsi<\/h2>\n          <p>Trattandosi di liberalit\u00e0 destinate a fini solidaristici, le donazioni regolarmente ricevute <strong>non sono rimborsabili<\/strong>, salvi i casi espressamente imposti da norme inderogabili di legge.<\/p>\n          <p>Nel caso di versamenti eseguiti per evidente errore materiale (es. transazione duplicata o importo palesemente errato per refuso di digitazione), il donatore pu\u00f2 presentare motivata richiesta entro 7 (sette) giorni dall'operazione scrivendo a <a href=\"mailto:info@gurunanaknaamlevasangat.org\">info@gurunanaknaamlevasangat.org<\/a>, allegando gli estremi identificativi della transazione. L'Associazione, verificate le circostanze e l'effettiva disponibilit\u00e0 delle somme (purch\u00e9 non gi\u00e0 vincolate o trasferite ai progetti), provveder\u00e0 all'eventuale storno al netto dei costi vivi bancari e delle commissioni trattenute dalla piattaforma.<\/p>\n        <\/section>\n\n        <section id=\"art-10\">\n          <h2><span>10.<\/span> Agevolazioni fiscali e ricevute<\/h2>\n          <p>In qualit\u00e0 di Ente del Terzo Settore iscritto al RUNTS, le erogazioni liberali a favore dell'Associazione possono beneficiare delle agevolazioni fiscali (detrazioni o deduzioni) previste dalla normativa tributaria applicabile tempo per tempo (in particolare ai sensi dell'art. 83 del D.Lgs. 117\/2017).<\/p>\n          <p>L'effettiva spettanza e la misura di tali benefici dipendono dalla qualifica soggettiva del donatore (persona fisica o ente\/societ\u00e0) e dal rispetto delle condizioni di legge previste dall'ordinamento tributario.<\/p>\n          <p>Ai fini dell'accesso alle agevolazioni fiscali, \u00e8 in ogni caso necessario che:<\/p>\n          <ul>\n            <li>l'erogazione liberale sia eseguita esclusivamente tramite <strong>strumenti di pagamento tracciabili<\/strong> (bonifico bancario, carte di pagamento o altri circuiti digitali previsti sul sito), con esclusione assoluta del contante;<\/li>\n            <li>il donatore fornisca tempestivamente all'Associazione i propri dati anagrafici completi e il proprio <strong>Codice Fiscale<\/strong> (o Partita IVA) per consentire l'emissione dell'attestazione e i conseguenti adempimenti fiscali.<\/li>\n          <\/ul>\n          <p>L'Associazione declina ogni responsabilit\u00e0 circa la mancata deducibilit\u00e0 o detraibilit\u00e0 derivante da incompletezza o inesattezza dei dati trasmessi dal donatore o da pagamenti non conformi ai criteri di tracciabilit\u00e0.<\/p>\n        <\/section>\n\n        <section id=\"art-11\">\n          <h2><span>11.<\/span> Protezione dei dati personali (Privacy)<\/h2>\n          <p>I dati personali conferiti nel processo di donazione sono trattati dall'Associazione in qualit\u00e0 di Titolare del trattamento ai sensi del Regolamento (UE) 2016\/679 (GDPR) e del D.Lgs. 196\/2003 e successive modifiche.<\/p>\n          <p>I dati sono raccolti e trattati esclusivamente per la gestione dell'erogazione, l'adempimento degli obblighi civilistici, contabili e fiscali, la prevenzione delle frodi e l'invio delle attestazioni di donazione. Per l'informativa estesa, i diritti dell'interessato e i tempi di conservazione, si rimanda alla <em>Informativa sulla privacy<\/em> pubblicata sul sito.<\/p>\n        <\/section>\n\n        <section id=\"art-12\">\n          <h2><span>12.<\/span> Modifiche ai Termini e Condizioni<\/h2>\n          <p>L'Associazione si riserva il diritto di aggiornare o modificare i presenti Termini e Condizioni in conformit\u00e0 a intervenute modifiche legislative, regolamentari o di prassi operativa. Le modifiche avranno efficacia dalla data di pubblicazione sul sito web e si applicheranno alle donazioni effettuate successivamente a tale data.<\/p>\n        <\/section>\n\n        <section id=\"art-13\">\n          <h2><span>13.<\/span> Legge applicabile e foro competente<\/h2>\n          <p>Le presenti condizioni sono regolate dalla <strong>legge italiana<\/strong>.<\/p>\n          <p>Per qualunque controversia relativa all'interpretazione, esecuzione o validit\u00e0 dei presenti Termini e Condizioni, qualora il donatore rivesta la qualifica di Consumatore ai sensi del D.Lgs. 206\/2005 (Codice del Consumo), sar\u00e0 competente in via inderogabile il giudice del luogo di residenza o domicilio elettivo del consumatore. Negli altri casi, sar\u00e0 competente in via esclusiva il Foro ove l'Associazione ha la propria sede legale.<\/p>\n        <\/section>\n\n        <section id=\"art-14\">\n Any bank charges or currency conversion costs applied by the intermediary chosen by the donor are borne by the donor, or may be deducted from the net amount received by the Association in accordance with the provider's terms.<\/p>\n        <\/section>\n\n        <section id=\"art-5\">\n          <h2><span>5.<\/span> Use and management of funds and international transfers<\/h2>\n          <p>The funds received are managed by the Association with diligence and transparency and are restricted to its statutory institutional activities, in compliance with accounting rules and with the prohibition on distributing profits or surpluses, even indirectly (Article 8 of Legislative Decree 117\/2017).<\/p>\n          <p>Funds may be transferred to India to carry out initiatives directly or through partner entities, suppliers or local non-governmental organisations. To this end, the Association operates in full compliance with:<\/p>\n          <ol>\n            <li>anti-money laundering and counter-terrorist financing legislation (Italian Legislative Decree 231\/2007 as amended);<\/li>\n            <li>local regulations applicable to international transfers to India, including compliance with the <em>Foreign Contribution Regulation Act<\/em> (FCRA) and the use of authorised banking channels.<\/li>\n          <\/ol>\n        <\/section>\n\n        <section id=\"art-6\">\n          <h2><span>6.<\/span> Donations to specific projects<\/h2>\n          <p>Where the website allows a donation to be directed to a campaign or a specific project, the Association undertakes to allocate the amount to the chosen project, subject to operational feasibility and the fundraising target being reached.<\/p>\n          <p>If the chosen project is already fully funded, suspended, completed or objectively impossible to carry out, the Association will, where possible, inform the donor in order to agree on reallocating the donation to a similar initiative. Failing that, the funds will be used for other humanitarian projects consistent with the original purpose and with the Association's statutory aims.<\/p>\n        <\/section>\n\n        <section id=\"art-7\">\n          <h2><span>7.<\/span> Operating and administrative costs<\/h2>\n          <p>To ensure proper coordination, field monitoring, bookkeeping and the technical management of fundraising platforms, a reasonable and documented share of the funds raised may be allocated to administrative and general support costs, always within the standards of appropriateness and efficiency required of Third Sector Entities.<\/p>\n        <\/section>\n\n        <section id=\"art-8\">\n          <h2><span>8.<\/span> Reporting and transparency<\/h2>\n          <p>The Association keeps regular accounting records and prepares its annual financial statements and fundraising reports in accordance with the applicable ministerial guidelines (Ministerial Decree of 9 June 2022 and Article 87 of Legislative Decree 117\/2017).<\/p>\n          <p>Financial reports, mission reports and updates on completed initiatives are published on the institutional website in fulfilment of disclosure and transparency obligations. Images or data concerning beneficiaries are always shared in a way that protects the dignity, honour and privacy of the people assisted.<\/p>\n        <\/section>\n\n        <section id=\"art-9\">\n          <h2><span>9.<\/span> Refunds<\/h2>\n          <p>As charitable gifts for solidarity purposes, donations duly received are <strong>non-refundable<\/strong>, except where mandatory provisions of law require otherwise.<\/p>\n          <p>In the case of payments made through an obvious error (e.g. a duplicate transaction or a clearly wrong amount due to a typing mistake), the donor may submit a reasoned request within 7 (seven) days of the transaction by writing to <a href=\"mailto:info@gurunanaknaamlevasangat.org\">info@gurunanaknaamlevasangat.org<\/a> and attaching the transaction details. After verifying the circumstances and the actual availability of the funds (provided they have not already been committed or transferred to projects), the Association will arrange any refund net of bank charges and of fees withheld by the payment platform.<\/p>\n        <\/section>\n\n        <section id=\"art-10\">\n          <h2><span>10.<\/span> Tax benefits and receipts<\/h2>\n          <p>As a Third Sector Entity registered with RUNTS, donations to the Association may qualify for the tax benefits (tax credits or deductions) provided for by the tax legislation in force from time to time (in particular under Article 83 of Legislative Decree 117\/2017).<\/p>\n          <p>Eligibility for, and the amount of, these benefits depend on the donor's status (individual or entity\/company) and on meeting the conditions set by Italian tax law. These benefits apply to taxpayers in Italy; donors resident abroad should check the rules of their own country.<\/p>\n          <p>In order to access the tax benefits, it is in any case necessary that:<\/p>\n          <ul>\n            <li>the donation is made exclusively through <strong>traceable payment methods<\/strong> (bank transfer, payment cards or other digital methods available on the website); cash is strictly excluded;<\/li>\n            <li>the donor promptly provides the Association with their full personal details and their <strong>Tax Code<\/strong> (Codice Fiscale or VAT number) so that the donation certificate can be issued and the related tax obligations fulfilled.<\/li>\n          <\/ul>\n          <p>The Association accepts no liability if a donation is not deductible or eligible for a tax credit because the details provided by the donor are incomplete or inaccurate, or because the payment did not meet the traceability requirements.<\/p>\n        <\/section>\n\n        <section id=\"art-11\">\n          <h2><span>11.<\/span> Personal data protection (Privacy)<\/h2>\n          <p>Personal data provided during the donation process are processed by the Association as Data Controller under Regulation (EU) 2016\/679 (GDPR) and Italian Legislative Decree 196\/2003 as amended.<\/p>\n          <p>Data are collected and processed solely to manage the donation, fulfil civil, accounting and tax obligations, prevent fraud and send donation certificates. Changes take effect from the date of publication on the website and apply to donations made after that date.<\/p>\n        <\/section>\n\n        <section id=\"art-13\">\n          <h2><span>13.<\/span> Governing law and jurisdiction<\/h2>\n          <p>These terms are governed by <strong>Italian law<\/strong>.<\/p>\n          <p>For any dispute concerning the interpretation, performance or validity of these Terms and Conditions, where the donor is a Consumer under Italian Legislative Decree 206\/2005 (Consumer Code), the court of the consumer's place of residence or elected domicile has mandatory jurisdiction.
